The Digital Container Shipping Association (DCSA) announced that moving away from the physical paper transfer of BLs could save US$6.5 billion in direct costs for stakeholders, enable US$30-40 billion in annual global trade growth, transforming the customer experience and improving sustainability.
The announcement by the nine shipping lines belonging to this association confirmed what we already knew: electronic bill of lading is here to stay.
Seeking clear rules for the purpose of providing certainty to states, especially because of the uncertainty that exists about the legal value of electronic transferable documents, is that the United Nations Commission on International Trade Law approved in 2017 the Model Law on Electronic Transferable Documents.
The purpose of the model law is to help states improve their legislation on electronic commerce, as well as to have a regulation that is uniform for all taking into account that commercial transactions occur across borders. Due to the clear trend in the maritime sector to accept electronic bills of lading, it is important that we start looking at how to legislate on this matter. And the analysis of this law is a good way to start.
